1. Acceptance of Terms
By accessing and using My Backup Card ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
My Backup Card is a service that allows users to create encrypted data stores and emergency cards for storing critical information such as medical data, emergency contacts, and other personal information.
3. Age Restrictions
You must be at least 13 years of age to use this Service. If you are under 18, you represent that you have obtained parental or guardian consent to use this Service. By using the Service, you represent and warrant that you meet this age requirement.
4. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Maintain the security of your password and account
- Accept all responsibility for activities that occur under your account
- Notify us immediately of any unauthorized use of your account
5. Data Encryption and Security
My Backup Card uses client-side encryption (AES-GCM) to protect your data. All encryption and decryption occurs locally in your browser before data is transmitted to our servers. We use a zero-knowledge architecture, meaning we cannot access your unencrypted data. You are solely responsible for maintaining the confidentiality of your encryption passphrase and any recovery information.
6. User Responsibilities
You agree to:
- Use the Service only for lawful purposes
- Not use the Service to store or transmit any illegal, harmful, or malicious content
- Not attempt to gain unauthorized access to the Service or its systems
- Not interfere with or disrupt the Service or servers connected to the Service
- Not use automated systems to access the Service without our express written permission
- Maintain backup copies of your data independently of this Service
7. Account Deletion
You may delete your account at any time through the User Settings page. Upon account deletion, all data associated with your account will be permanently deleted within 24 hours. This action cannot be undone. We recommend exporting or backing up any important data before deleting your account.
8. Service Availability
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be available at all times, uninterrupted, secure, or error-free. The Service may be modified, suspended, or discontinued at any time without notice.
9. Limitation of Liability
To the maximum extent permitted by law, My Backup Card and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
10. Indemnification
You agree to indemnify and hold harmless My Backup Card and its operators from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
